Optus TV Now case: TV 'time-shifting' sport services

The Full Federal Court decision relating to Optus's TV Now service has provided clarity for sporting organisations regarding the right to control sporting broadcasts in an online environment.
In this eBulletin, which was published in the World Sports Law Report, we discuss the decision made by the Federal Court of Australia, the appeal to the Full Federal Court and the High Court of Australia’s decision to refuse special leave to appeal. We also look at the current position under Australian law and the Australian Government inquiry into the Copyright Act 1968 (Cth) in the digital environment.
