Kristy is an experienced professional indemnity insurance lawyer with a career in both private practice and as a claims manager at an international professional and financial risk underwriter.

Experience

Kristy advises professional indemnity and professional liability insurers and policy holders in the building and construction space. This includes handling complex upstream and downstream disputes involving principals, head contractors and construction professionals in relation to commercial and domestic building projects.

Having recently worked as a claims manager at an international professional and financial risk underwriter, Kristy has extensive experience managing complex and high-value insurance claims and advising insurers and stakeholders in relation to a range of indemnity issues.

Kristy's career highlights include:

  • managing an insurance claim relating to litigation between the head D&C contractor against the insured DJV with respect to the design of a metropolitan train tunnel in NSW
  • managing an insurance claim relating to arbitration commenced in Singapore in relation to the design of a tungsten mine in Vietnam
  • managing an insurance claim relating to litigation in VCAT and the Supreme Court of Victoria by the owner against a geotechnical engineer and 10 other parties in relation to a defective warehouse slab
  • managing an insurance claim relating to litigation commenced in the Supreme Court of Victoria against a structural engineer in relation to alleged defective slab designs of 100 homes in a new estate
  • acting for a global marine and civil engineering contractor in respect of two large-scale arbitrations in WA
  • acting for a structural engineer in a multi-party proceeding and negotiating settlement in circumstances where the matter proceeded to hearing between remaining parties; drafted complex terms of settlement
  • acting for a national firm of architects and its professional indemnity insurer in relation to an arbitration commenced by the State Government (as principal of construction of state hospital)
  • acting for and advising professional indemnity insurers in relation to litigated professional negligence claims against building and construction professionals.
