Kate Mitchell

Senior Associate

Kate has worked exclusively in family and relationship law since her admission in 2019.

Before joining Lander & Rogers, Kate worked as a Legal Associate at the Court for over two years. This experience exposed Kate to the full spectrum of family law matters, including those involving complex financial and parenting issues as well as specialised international family law matters. Kate applies her unique understanding of the nuances of the court system when advising her clients.

When working with Kate you can expect a measured but determined advocate who will take time to listen and understand the needs of you and your family. Kate will guide you through the family law process and work with you to reach a resolution as early as possible, so you can plan for your future.

Prior to working at the Court Kate spent six months studying International Law and Business at the ZHAW School of Management and Law in Zürich, Switzerland.

Experience

Kate's areas of expertise include assisting clients in Australia and overseas with:

  • property settlements ranging in asset pool size and method of outcome, including negotiated matters and litigated matters
  • drafting binding financial agreements for couples at all stages of their relationships and for asset planning purposes
  • spousal maintenance
  • parenting arrangements for the care of children, including children at risk and family violence matters
  • international matters including international financial matters, international abduction matters (also known as Hague Convention matters) and relocation matters
  • child support
  • divorce applications.

Career highlights

Kate's career highlights include:

  • successfully running proceedings in the Federal Circuit and Family Court of Australia and the Federal Court of Australia which related to seeking injunctive relief against the acquisition of another business and considering and valuing significant and complex business and personal assets
  • successfully obtaining an order for sole parental responsibility and sole time on an undefended basis for an at-risk child in circumstances of significant mental health and family violence issues and concerns regarding international child abduction
  • successfully assisting a client to obtain a property settlement where one party was residing overseas and the parties had assets both in Australia and overseas
  • representing a party in court proceedings to prove the existence of a de facto relationship within the meaning of the Family Law Act.
